General Points

·         Apna Drive Guru is the only providing Instructor for practice on own car Familiarization with Vehicle with apnadriveguru.com

·         Apna Drive Guru provides online booking facility only for Apna Drive Guru learner and Instructor. It provides listing of Instructor.

·         Students are requested to complete driving training at a stretch, any break in between needs to be communicated to Apna Drive Guru 24-48 hours prior to avail uninterrupted service

·         The arrival and departure times mentioned on the website are tentative timings. In case Driving class doesn't have a preferred slot available then timings shall be changed in agreement with customer.

·         Students are required to furnish learner's license or driver's license or else training might get stopped.

Payments Policy:

·         In case charges and incidental charges towards RTO services (LL/DL/Road Tax/Address Change/etc) there might a difference in pricing, which usually happens due to lack of proper documentation, penalty or any other valid reason. Customer shall bear the differential amount to get the services done.

·         Government authorities issue the document and certificates and hence Apna Drive Guru is not responsible for any discrepancy or mismatch in your name, address, date of birth, vehicle information or any other information on the certificate that is issued by authority. Getting it updated or changed might attract additional fee that you customer has to bear.

·         You as customer agree to pay for services that you avail through Apna Drive Guru. Hereby you authorize Apna Drive Guru to charge your card/bank account an amount as shown on your booking.

·         Your card details will be processed by our 128 bit secured payment gateway. You can pay with MasterCard, Visa, Debit Cards, Credit card or Net Banking.

·         You can also pay by cash directly to Apna Drive Guru or to our affiliate Instructor but we advise you to pay to Apna Drive Guru directly so that we can control the quality of services for you.

·         Without payment Apna Drive Guru shall not start your services.

Refunds Policy:

·         Any cancellations or amendments in the booking at any time before service date must be dealt with us by calling at +91-9920587888 or write us at apnadriveguru@gmail.com.

·         Booking amount you pay also includes 10% booking administration charges which are non-refundable in any case.

·         All refunds will be strictly made of same credit card or bank account which was used to pay for booking.

·         Apna Drive Guru may take up to 2 weeks to process refunds for cancelled bookings following the above process. Your bank may debit its own separate charges from refunds made to your credit card or bank account. The amount would reflect in your account within the below mentioned timeline.

o    7-9 business days for Debit Card.

o    15 business days or in next billing statement for Credit card.

o    4-5 business days for Net-banking.

·         If a customer is coming back to resume the services after 1 month, no refund will be applicable and customer need to make re-payment if willing to take service again.

Apna Drive Guru responsibilities include:

·         Providing customer support and information in case of any issues / inconvenience / complaints.

·         Collecting the payment from customer online.

·         Refunding the amount in case as applicable, subject to refund policy above.

Apna Drive Guru responsibilities do NOT include:

·         Any injury occurred to Student while driving training.

·         The baggage of the student getting lost / stolen / damaged while carrying during learning.

·         The student waiting at the wrong boarding point.

·         In case a confirmation e-mail and SMS gets delayed or fails because of technical reasons or as a result of incorrect e-mail ID / phone number provided by the student etc, However Apna Drive Guru tries to re-send confirmation e-mail and SMS again within 2 hours or immediately upon bringing it to the notice.

Communication Policy

·         By accepting the terms and conditions, the student accepts that Apna Drive Guru may send the alerts to the mobile phone number provided by the student while enquiring for the service or to any such number replaced and informed by the student. The student acknowledges that the alerts will be received only if the mobile phone is in 'On' mode to receive the SMS. If the mobile phone is in 'Off' mode then the student may not get / get after delay any alerts sent during such period. Apna Drive Guru will make best efforts to provide the service and it shall be deemed that the student shall have received the information sent from Apna Drive Guru as an alert on the mobile phone number provided during the course of booking and Apna Drive Guru shall not be under any obligation to confirm the authenticity of the person(s) receiving the alert. The student cannot hold Apna Drive Guru liable for non-availability of the service in any manner whatsoever.

·         The student acknowledges that the SMS service provided by Apna Drive Guru is an additional facility provided for the student convenience and that it may be susceptible to error, omission and/ or inaccuracy. In the event the student observes any error in the information provided in the alert, Apna Drive Guru shall be immediately informed about the same by the student and Apna Drive Guru will make best possible efforts to rectify the error as early as possible. The student shall not hold Apna Drive Guru liable for any loss, damages, claim, expense including legal cost that may be incurred/ suffered by the student on account of the SMS facility.

·         The student acknowledges that the clarity, readability, accuracy, and promptness of providing the service depend on many factors including the infrastructure, connectivity of the service provider. Apna Drive Guru shall not be responsible for any non-delivery, delayed delivery or distortion of the alert in any way whatsoever.

·         The student agrees to indemnify and hold harmless Apna Drive Guru and the SMS service provider including its officials from any damages, claims, demands, proceedings, loss, cost, charges and expenses whatsoever including legal charges and attorney fees which Apna Drive Guru and the SMS service provider may at any time incur, sustain, suffer or be put to as a consequence of or arising out of (i) misuse, improper or fraudulent information provided by the student, (ii) the student providing incorrect number or providing a number that belongs to that of an unrelated third party.

·         By accepting the terms and conditions, the student acknowledges and agrees that Apna Drive Guru may call the mobile phone number provided by the student while registering for the service or to any such number replaced and informed by the student, for the purpose of collecting feedback from the student regarding their learning, the driving facilities and/or services of the driving school.

·         Grievances and claims related to the driving should be reported to Apna Drive Guru support team within 15 days of your learning.

·         Our customers or potential customers grants Apna Drive Guru, its consultant, its employees, or its associates rights to call back on their mobile or land line if they provide Apna Drive Guru the number electronically through web request or email, or call us to use services or seek any help. This applies even if their numbers are registered in DnD.

·         Customer will be refunded the money back on prorate basis in case partial services were already rendered to him. Booking administration charges are applicable. For example customer pays to Apna Drive Guru for 10 days of training classes but receives only 5 days of training from service provider then in this case customer will be refunded half of the amount minus booking administration charges (10%).

Collection of Personally Identifiable Information and other Information

 

When you use our Website, we store your browsing information. Our primary goal in doing so is to provide you a safe, efficient, smooth and customized experience. This allows us to provide services and features that most likely meet your needs, and to customize our Website to make your experience safer and easier. More importantly, while doing so we collect personal information from you that we consider necessary for achieving this purpose.

In general, you can browse the Website without telling us who you are or revealing any personal information about yourself. Once you give us your personal information, you are not anonymous to us. Where possible, we indicate which fields are required and which fields are optional. We use this information to do internal research on our users' demographics, interests, and behavior to better understand, protect and serve our users. This information is compiled and analyzed on an aggregated basis. This information may include the URL that you just came from (whether this URL is on our Website or not), which URL you next go to (whether this URL is on our Website or not), your computer browser information, and your IP address.

We collect personally identifiable information (email address, name, phone number.) from you when you set up a free account with us. We do use your contact information to send you offers based on your previous orders and your interests.


 

Payment Terms:

·         Transactions, transaction price and all commercial terms such as place of service, rendering of services are as per principal to principal bipartite contractual obligations between you and service recipient and the payment facility is merely used by you and service recipient to facilitate the completion of transactions. Use of the payment facility shall not render ADG liable or responsible for non-delivery, non-receipt, non-payment, damage, breach of representations and warranties, or warranty services or fraud as regards the services listed on the Website.

·         You have specifically authorized ADG or its service providers to collect, process, facilitate, and remit payments and/or the transaction price electronically to and from service recipient in respect of transactions through payment facility. Your relationship with ADG is on a principal to principal basis and by accepting this Agreement, you agree that ADG is an independent contractor for all purposes and does not have control of or liability for the products or services that you provide and paid for by using the payment facility. ADG does not guarantee the identity of any User nor does it ensure that a service recipient or a you will complete a transaction.

·         You understand, accept, and agree that the payment facility provided by ADG is neither a banking nor financial service, but merely a facilitator providing an electronic, automated online electronic payment facility for receiving payment, collection and remittance for transactions on the Website using the existing authorized banking infrastructure and credit card payment gateway (PG) network. Further, by providing payment facility, ADG neither acts as a trustee nor fiduciary with respect to transaction or transaction price.

You agree that the transaction price paid by a service recipient will be remitted to your bank account contingent upon the following events:

·         Service recipient confirms the rendering of services in the transaction;

·         Service recipient refund claim is rejected by ADG due to any breach of the Agreement, policies, and any applicable law;

·         Remittances to you (after deduction of commissions at applicable rates) for successful transactions may be made in multiple transactions through its bank accounts and would be in compliance with directions issued by the Reserve Bank of India (RBI) for opening and operation of accounts and settlement of payments for electronic payment transactions involving intermediaries vide its notification RBI/2009-10/231 DPSS.CO.PD.No.1102 / 02.14.08/ 2009-10 dated November 24, 2009 ('RBI Intermediary Guidelines').

Fee Policy:

·         ADG collects the amount paid by a service recipient for any transaction made. ADG deducts as selling commission a percentage of the service value, plus a fixed per-service fee (herein after referred to as "Fee")

·         ADG shall raise an invoice on the seller on every _____ (last day of the month, as appropriate) towards Fee due and payable by you to ADG. Payments towards such invoices shall be deducted by ADG from your remittances or if there is no monies to the credit of your account, in such event, you shall be liable to pay such Fee to ADG within 7 days from the date of the invoice.

·         Parties expressly agree that any/all remittance/settlement related payouts shall be deemed to have been accepted by you if you do not furnish a written objection specifying the nature of the dispute within ninety (90) days from the date of transaction.
